Official Announcement: Non-profit Status 501(c)(3)

My name is Troy Blanchard. I am an official spokesperson for DSUHC.

Last week DSUHC was formed as a nonprofit corporation pursuant to Utah Revised Nonprofit Corporation Act, Utah Code Ann. §16-6a-101 et. seq. (1953, as amended. The corporation is organized and shall be operated exclusively as a non-profit corporation for charitable, educational, or scientific purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code of 1986, as amended. Without limiting the generality of the foregoing, the Corporation is specifically organized to promote the spirit of Southwest Utah’s historical legacy and any and all activities related or incidental thereto for charitable, educational, or scientific purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code of 1986, as amended, through activities necessary, incidental or related thereto. The Corporation may make distributions to organizations that qualify as exempt organizations under Section 501(c)(3) of the Internal Revenue Code, or corresponding section of any future federal tax code, and engage in any lawful act for which a nonprofit corporation may be organized under the Utah Revised Nonprofit Corporation Act, Utah Code Ann. §16-6a-101 et seq., insofar as consistent with its status as a 501(c)(3) organization.

It is intended that the Corporation shall have the status of a corporation which is exempt from federal income taxation under Section 501(a) of the Code as an organization described in Section 501(c)(3) of the Code and which is other than a private foundation by reason of being described in Section 509(a)(2) of the Code. These Articles shall be construed accordingly, and all powers and activities of the Corporation shall be limited accordingly.

At a meeting of the Steering Committee, board members and officers were selected and are now functioning in their respective positions.

DSUHC will provide additional information on opportunities for tax deductible donations and also funding plans for charitable, educational, or scientific purposes or scientific purposes that promote the spirit of Southwest Utah’s historical legacy and any and all activities related or incidental thereto in the near future.
